1. Introduction

ModernPitching ("we", "our", or "us") operates the ModernPitching mobile application. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our app.

2. Information We Collect

We may collect the following types of information:

• Personal Information: Name, email address, and contact details provided during registration.
• Health & Fitness Data: Wellness logs, arm soreness ratings, sleep quality, energy levels, body composition, and hydration data you voluntarily submit.
• Wearable & Apple Health Data: Only if you connect them: from Whoop, sleep, recovery, heart rate variability and strain; from Apple Health (iPhone app), sleep and sleep stages, heart rate variability, resting and average heart rate, respiratory rate, blood oxygen, VO2 max, body weight, steps, active energy, exercise minutes, distance and workouts. Apple Health data is only read, never written, is used only to show your recovery and training to you and your coaches, is never used for advertising or sold, and is not shared with any other third party. You can disconnect in the app and withdraw access at any time in Health → Sharing → Apps.
• Performance Data: Training metrics, throwing velocities, workout logs, drill completions, and performance goals.
• Photos & Videos: Training videos and progress photos you upload for analysis and review.
• Usage Data: App interaction data, session activity, and feature usage for improving our services.
• Payment Information: Processed securely through Stripe; we do not store your payment card details.
• Device Information: Device type, operating system, and crash/diagnostic data.

3. How We Use Your Information

• To provide personalized training plans and coaching feedback.
• To enable communication between athletes and coaches.
• To track and display performance progress and wellness trends.
• To process payments and manage subscriptions.
• To send notifications about training, sessions, and app updates.
• To improve app functionality and user experience.
• To generate AI-powered analysis and recommendations.

3a. Videos, AI Analysis, and Improving ModernPitching

Videos are central to what we do, so we set out separately exactly what happens to them.

• Analysing your video to coach you. When you or your coach submit a video, it is processed to provide movement analysis, reports, and training guidance. AI features may involve external processing of the submitted video and relevant training information. Permission for optional reuse described below is separate from permission to share personal data with a third-party AI service.
• Improving our analysis (optional, off by default). With your permission, we may retain your videos and your coach's corrections and use them internally as reference material to make our analysis more accurate. This stays inside ModernPitching. It is never published, never shown to other clients, and never sold or licensed to anyone.
• Public use (optional, separate, off by default). We will never use your video anywhere an outsider could see it (social media, our website, presentations, teaching material) unless you have separately agreed to that specific use. Agreeing to help improve our analysis does not agree to this.

Both permissions start switched off. You are asked once when you sign up, you can change either at any time in Settings, and withdrawing takes effect immediately. Declining either one changes nothing about the coaching, analysis, or features available to you.

We keep a record of each permission you give or withdraw, including when it was given and which version of this wording you were shown. If we change what we are asking for in a material way, previous permissions stop applying and we ask again.

Athletes under 16. Dutch law sets the age of digital consent at 16. Where an athlete is under 16, these permissions must be given by a parent or guardian, and we record that they were. A young athlete ticking the box themselves does not count.

4. Data Sharing

We do not sell your personal data. We may share information with:

• Your Coach: Performance data, wellness logs, and training videos are shared with your assigned coach to provide personalized guidance.
• Service Providers: Third-party services (e.g., Stripe for payments, cloud hosting) that help us operate the app, bound by confidentiality agreements.
• Legal Requirements: When required by law or to protect our rights.

5. Data Storage & Security

Your data is stored securely using industry-standard encryption and security practices. We use secure cloud infrastructure to protect your information. While no method of transmission or storage is 100% secure, we strive to use commercially acceptable means to protect your data.

6. Data Retention

We retain your data while your account is active or as needed to provide the service. You can initiate account deletion in Settings → Danger, or Coach Settings → Danger Zone. The app asks you to confirm and reports whether cleanup completed. Uploaded files, third-party services, billing, and shared coaching records can currently require additional cleanup; if the app reports that deletion did not complete, contact Support. Deleting the app from your device does not delete your account or cancel a subscription.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access, correct, or delete your personal data.
• Withdraw consent for data processing.
• Request a copy of your data in a portable format.
• Object to or restrict certain data processing activities.

8. Children's Privacy

ModernPitching is used by young athletes, and accounts for athletes under 16 are expected to be set up and supervised by a parent, guardian, or club. Where an athlete is under 16, any optional permission described in section 3a must be given by a parent or guardian rather than by the athlete.

We do not knowingly collect personal information from a child under 13 without the involvement of a parent, guardian, or club. If you believe we hold information about a child that should not be here, contact us and we will remove it.

9. Third-Party Services

Our app may integrate with third-party services including Google Calendar, Google Drive, Notion, Stripe, Whoop and Apple Health. These services have their own privacy policies and we encourage you to review them.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes through the app or via email. Continued use of the app after changes constitutes acceptance of the updated policy.
